TERMS & CONDITIONS
The following Terms and Conditions govern each transaction between you and Dollars4Gold.
- All property sent to Dollars4Gold by you must be sent in the provided packaging
(G-Pak), via certified mail or by other carrier such that your shipment can be traced.
- In the event you use the G-Pak, your items will be insured for $500. In the event
you use your own packaging, you must insure your property with the carrier for its
full value and if it is lost or stolen prior to reaching Dollars4Gold you must make
a claim against the carrier. If you wish to insure your G-Pak for more than $500
you may do so at your own expense. Dollars4Gold utilizes the services of third party
carriers such as the United States Postal Service for the delivery of our G-Paks.
The tracking applications of these third party carriers will be the sole proof that
your items were mailed to Dollars4Gold.
- Dollars4Gold reserves the right to reject delivery of any package which appears
to be damaged, opened, or tampered with. Any such item will be returned to you by
the post office without further liability to Dollars4Gold.
- If your package is accepted, Dollars4Gold's liability will be limited to the lesser
of the following:
- 25% of the certified appraised value of your items if appraised within 90 days.
Dollars4Gold reserves the right to verify the appraisal document with a third party.
- The lesser of the current market liquidation value of your items, or one-half the
wholesale value of your items.
- The sum of Five Hundred Dollars ($500.00).
You expressly acknowledge and agree that if you do not provide an appraisal for your items which was issued 90 days prior to your claim of loss, Dollars4Gold’s liability will be capped at One Hundred Dollars ($100.00) and in no event will Dollars4Gold's Liability exceed $100.00.
- In no event will Dollars4Gold be liable to any third parties or insurance carriers,
nor will Dollars4Gold be liable for any loss of profit, loss of time or punitive
damages.
- Dollars4Gold complies with all local, State and Federal laws regarding the reporting
of precious metals and jewelry transactions.
- Any action brought against Dollars4Gold by you will be governed by the laws of the
State of Wyoming without regard to its conflict of law provisions and must be brought
in the State or Federal Courts located in Teton County, Wyoming. If you attempt
to bring action against Dollars4Gold in any other Jurisdiction you agree to reimburse
Dollars4Gold for any and all costs (including legal fees) incurred in defending
such action.
- You agree not to send in materials containing the following: Arsenic, Beryllium,
Bismuth, Cadmium, Mercury, Nickel, Lead, Antimony, Selenium, Tin, Tellurium or any
other deleterious elements.
- You have read and agree with the "Our Guarantee" section of the website, which constitutes
our return policy. That section reads, "if you are unhappy with the amount you receive
for your precious metals or for any other reason, simply call our toll-free number
and return the check so that it arrives in our offices within ten (10) days of the
date that appears on the check." You understand that failure to do so might result
in the processing of your property and that once processed, the property cannot
be recovered.
- Dollars4Gold does not purchase costume jewelry or items not containing precious
metals. Please note that items not containing precious metals WILL NOT BE RETURNED
by Dollars4Gold except that you may request these items be returned to you at your
expense. In such case, Dollars4Gold will charge a fifteen dollar ($15) fee to cover
return postage and processing in order to return items not containing precious metals
to you. Your items will be sent COD. If you are unsure whether your items
contain precious metals you can refer to the 'How Can I Tell if My Jewelry is Real'
link on our website.
- Dollars4Gold does not purchase gemstones. If you plan to send in an item that contains
a stone which you believe to be valuable, we strongly recommend removing the stone(s)
prior to sending it in to us.
- Once your items have been received in the refinery they will be assessed and a check
will be sent out to you within 24 hours of such assessment. Items are delivered
to the refinery five (5) days per week, Monday through Friday, exclusive of national
holidays or weekends. In the event the 24 hour period would extend into a weekend
or holiday, your items will be processed and a check issued the first business day
following the holiday or weekend. The 24 hour period does not include the time it
takes for your check to be delivered to you.
- You warrant to Dollars4Gold that you have:
- good and marketable title to the property you send in; and
- full authority to sell and transfer said property; and that
- said property is sold free of all liens, encumbrances, liabilities, and adverse
claims of every nature and description whatsoever; and that
- said property is not from, or the result of, illegal activity in this country or
any other country; and that
- you are at least twenty-one (21) years of age; and that
- any transaction initiated by you will not cause Dollars4Gold to be in violation
of any anti-money laundering, anti-terrorism, or other applicable law of the U.S.,
any state or any foreign country; and that
- you are the actual legal owner of any and all property offered to be sold to Dollars4Gold
(Dollars4Gold may, but shall not be required to, ask you to provide documentation
or other proof of such ownership) and you are acting on your own behalf.
- You agree to indemnify and hold harmless Dollars4Gold against any and all liability,
claims, suits, losses, costs and legal fees (paid in advance) caused by, arising
out of, or resulting from any breach or claimed breach of these Terms and Conditions,
including claims brought by third parties. You further warrant that you will fully,
defend, protect, indemnify, and hold harmless Dollars4Gold and its lawful successors
and assigns from any adverse claim thereto.
- These Terms and Conditions are subject to change. We recommend that you revisit
our website, dollars4gold.com, periodically to ensure that you are aware of our
current Terms and Conditions. Additionally, we will prominently note on our website
that our Terms and Conditions have been changed and provided you did not elect to
no longer receive correspondence from us, you will be notified via e-mail that changes
have been made to our Terms and Conditions.
